Contractual rights
Once a contract has been formed with a set total price, the seller has a legal obligation to honour this price and the buyer has a right to have the goods delivered at that price.
Example - attempt to increase delivery charge after sale
The owner of a small plumbing business buys £750 of water pipes and fittings from a trade supply website. The delivery charge is £12.95 giving a total price of £762.95. The next day a phone call is received from the seller advising that due to delivery to an IV postcode area, the delivery charge is raised to £60, giving a total of £830.
Buyer's Rights
The plumbing business has the right to receive the goods for payment of £762.95, or to cancel the purchase.
What can the buyer do?
- Claim for implementation of the deal for £762.95 as agreed, OR
- Refuse to pay and abandon the purchase
