Misleading Marketing

The Business Protection from Misleading Marketing Regulations 2008 (“the BPRs”) prohibit misleading business-to-business advertising.  This includes matters relating to price and general statements and claims made on websites.  If a business buyer has been misled as to the delivery charge that applies to a purchase, then there may be a breach of BPRs.  One form of this may be unqualified offers relating to a money threshold (e.g. “free delivery for orders over £100” when in fact it only applies to certain geographical destinations).  Another is where a significant surcharge is added after the purchase has been made.

Local Authority Trading Standards Services are responsible for enforcement of the BPRs.

Report a breach to your local Trading Standards Service

Online Advertising

Another option is to report the matter to the Advertising Standards Authority (ASA) which will consider complaints about online and distance sellers whose advertisements contain misleading delivery charge claims.
